Criminal Injuries Compensation Scheme

If you have been physically assaulted you could be entitled to compensation for your injuries from the Government’s Criminal Injuries Compensation Authority (CICA).

Criminal Injuries Compensation Authority (CICA)

The Criminal Injuries Compensation Authority (CICA) pays out more than £150m a year to victims of violent crime.

Depending on the severity of your injuries, you could be entitled to awards ranging from £1,000 to £500,000 from the Government scheme.

Many awards are for more than £25,000 – some are increased further on appeal.

What is the criminal injuries compensation scheme?

The Criminal Injuries Compensation Scheme (CICS) is offered by the government to provide financial compensation to those injured from violent crimes. The scheme supports victims of crime who suffer physical or psychological harm due to criminal acts, by offering compensation for their pain, suffering, and financial losses.

How to make a CICA claim
You can submit a CICA claim directly to the criminal injuries compensation authority.

The government provides a comprehensive 82-page guide detailing 146 points in the table of contents for seeking criminal injury compensation

However, many people find the process daunting and prefer to seek professional legal support.

Expert legal support with your claim for criminal injuries

If the process feels daunting or complicated, legal experts specialising in the criminal injuries compensation scheme can be a great help in submitting your application. When submitting a claim for criminal injuries on your behalf, CICA experts, Hudgell Solicitors will ensure the CICA is fully informed about the impact the crime had on you physically and psychologically now and in the future, but also the impact on your earnings, all of which should be considered when calculating your case.

Hudgells CICA experts understand that as a victim of crime, how much compensation you are awarded could depend on the evidence you submit with your claim.

In 60% of cases where CICA offers an award of £25,000 and above, a CICA solicitor represents the applicant to ensure you get the highest amount of compensation possible.

It is recommended you seek advice from a specialist CICA claims team to ensure you secure the maximum award in the quickest time possible. The process will also be simpler.

How much compensation will I get?

CICA compensation is calculated on the physical and mental injuries a victim of violent crime has suffered – you could be entitled to an award for both.

How much compensation you will get depends on the severity of physical and mental injuries based on the CICA’s ‘Tariff of Injuries’ table.

CICA Tariff of Injuries

For example, head and brain injuries can have a serious and lasting impact and the Criminal Injuries Compensation Authority (CICA) calculates compensation awards as:

CICA Head Injury Awards

Moderate brain damage

Depending on: intellectual deficit, personality change, ability to work reduced, effect on the senses, dependency on others.

£22,000 to £55,000

Moderately severe brain damage

Depending on: serious disablement of physical or mental faculties requiring substantial dependence on professional or other care, with abnormal behaviour and poor communication.

£82,000 – £110,000

Very serious brain injury

Severe physical limitation, little or no meaningful response to the environment, little or no language function and need for nursing care.

£175,000 to £250,000

CICA Mental Injury Awards

Permanently and seriously disabling £27,000
Permanent and moderately disabling mental injury £19,000
Mental injury lasting five years or more but not permanent £13,500

CICA Reviews & Appeals

Around 30% of the CICA compensation awards are changed following a successful CICA appeal.

Applicants who disagree with a CICA decision can request a review and, if still dissatisfied can appeal to an independent panel.

Analysis by the Association of Personal Injury Lawyers (APIL) showed that of 379 cases which reached appeal in 2022/23, offers increased from an average of £7,848 to an average of £47,339 – six times more per person.

If your application for CICA compensation has been rejected, or if you had been expecting to be offered more damages, it is worth speaking to Hudgells legal team today for advice as to whether it would be worth making a CICA appeal.

£48k awarded to victim who was viciously beaten

The victim was left with a split palate and a fractured jaw and suffered from severe PTSD after being attacked by her friend’s partner. She underwent surgery for extensive injuries, which also included a fractured eye socket and injuries to her teeth.  During the horrifying attack she was punched to the ground, then repeatedly stamped on her face.

The criminal injuries compensation scheme offered her £1,800, compensation for the violent crime – but only after Hudgell Solicitors stepped in to appeal the CICA offer was she awarded £48,000.

“Everything I used to do as part and parcel of every day is now a struggle, I’m constantly tired and I suffer really severe headaches…

I was told that I’d be able to apply for compensation by the police, and to be honest, as there had been no court case or anything I didn’t expect to get anything. I was delighted to get the award as it has been a big help to us and we’ve been able to put the money to good use.

Hudgell Solicitors were absolutely brilliant and couldn’t have done more for me. Tracy was fantastic, she answered every question I had and anything that needed doing she sorted for me. I was really lucky to have her.”
